TAFE Part Time Casual Teachers

TAFE IRC decision

4 At 4pm today ( Monday 20 December 2004) the Full Bench of the Industrial Relations Commission will bring down its decision in relation to the pay and conditions of part-time/casual teachers in TAFE.

Seventy per cent of TAFE teachers are employed on a casual basis.

The case, lodged by the Federation in 2003, seeks to provide equal pay and conditions to teachers technically employed on a casual basis but in reality performing the same or similar work as permanent teachers. Teachers in the public education system hope that the disparity in pay and conditions between full-time TAFE teachers and part-time casual TAFE teachers will be justly resolved by the NSW Industrial Relations Commission.

Today the Full Bench of the Industrial Relations Commission brought down a decision that recognises the similarity in work value between some TAFE part-time casual teachers and the work of permanent full-time teachers.

The Bench sent the parties away to negotiate an appropriate award variation by 31 January 2005. The variation must include betterments for part-time casual teachers. The real issue will be at what number of teaching hours per week pro rata pay and conditions will kick in. Whatever the outcome it will be better than the current exploitation of people over long periods.

The award variation will also include a travel allowance for part-time casual teachers required to use their vehicles in the performance of their duties and betterments to the definition of "service" for the purposes of long service leave accumulation.

If the parties cannot agree on the betterments to be included in the award variation , then by 15 February the parties must file their version of the appropriate award variation and contentions to support that version. There will be a Hearing if necessary.
