TAFE Teachers Enterprise Agreement 2025-2028

Federation welcomes an in-principle agreement for the TAFE Commission of NSW Teachers and Related Employees Enterprise Agreement 2025-2028.

The proposed three-year agreement includes:

  • increases to salaries and salary-related allowances of:
    • 3.5 per cent from the first full pay period that commences on or after 1 February 2025; and
    • 3 per cent from the first full pay period that commences on or after 1 February 2026; and
    • 3 per cent from the first full pay period that commences on or after 1 February 2027
  • increases to salaries and salary-related allowances outlined in 4.1.1 to be paid to employees no later than 28 February 2025
  • a $1000 taxable, one-off cost of living adjustment payment, plus superannuation, conditional on the 12-month annual average Sydney Consumer Price Index rate exceeding 4.5 per cent in the year to the March quarter of 2025, 2026 and 2027.  The payment would be pro-rated for employees who do not work on a permanent or temporary full-time basis and will be paid in July 2025, July 2026 and/or July 2027
  • the superannuation guarantee levy increase under the Superannuation Guarantee (Administration) Act 1992 (Cth) during the life of the new Enterprise Agreement; an increase of 0.5 per cent from 1 July 2025.

The offer also provides improvements in the following working conditions:

  • amendments to clause 12, to facilitate improvements to the Annual Teacher Review (ATR) process for Teachers and Related Employees through an agreement to jointly develop and/or amend any relevant written policies, procedures, guidance and support materials. The replacement ATR will be developed collaboratively through an interest-based approach in good faith and consultation on any matters pertaining to a replacement of the ATR
  • the term ‘Part-Time Casual Teacher’ will be replaced with ‘Casual Teacher’
  • alignment of casual employment duration to six months, unless it is by voluntary choice of a TAFE NSW casual employee to remain engaged and offered hours of work in that way.

YES. Federation strongly recommends that TAFE members vote YES in support of the proposed Enterprise Agreement 2025-2028.

A three-year agreement, with a nominal expiry date of 31 January 2028.

  • Salaries and related allowances will be increased by:
    • 3.5 per cent from the first full pay period that commences on or after 1 February 2025
    • 3 per cent from the first full pay period that commences on or after 1 February 2026
    • 3 per cent from the first full pay period that commences on or after 1 February 2027
  • A 0.5 per cent increase in the superannuation guarantee levy from 1 July 2025.

Increases to the superannuation guarantee are mandated by federal legislation. As of 1 July 2025, the superannuation guarantee will increase from 11.5 per cent to 12 per cent, which is the final increase mandated by the legislation.

The cost of living adjustment is a safeguard in case inflation rises above 4.5 per cent on a 12-month annual average for the March quarter of each year over the life of the new Enterprise Agreement.

No. Conversion to permanency for part-time casual teachers will continue to be voluntary.

Changes to the Enterprise Agreement

Yes. The Part-Time Casual teacher classification will be changed to “Casual Teacher”, but all other part-time casual conditions remain unchanged.

Yes. The sessional teacher classification will be removed as there are currently no sessional teachers employed by TAFE NSW.

Yes. It is proposed to amend Clause 12 of the current enterprise agreement to include a jointly developed replacement for the Annual Teacher Review. The new agreed process is to be implemented at the start of 2026 and will provide a guide for meaningful professional development for teachers and related employees.

No. Teachers will continue to have an entitlement of seven non-attendance weeks and four weeks of annual leave. However, changes will be made to the Enterprise Agreement in clause 27 “TAFE Year” and clause 28 ”Additional One Week”, to encourage greater use of the “TAFE year”.

For those teachers who exclusively work on AMEP and/or SEE contracts, teaching weeks will be extended from 36 to 40 weeks. However, the annual teaching hours for teachers will remain at 720 hours (pro-rata for those who work part time).  Teachers who do not exclusively work on AMEP and or SEE contracts will continue to teach across 36 weeks per year.

Yes. A new clause will be added to the Enterprise Agreement to provide TAFE NSW employees to disconnect under section 333 M of the Fair Work Act 2009 (Cth).

Yes. A new clause has been added to the Enterprise Agreement to enshrine this right/entitlement under section 333 M of the Fair Work Act 2009 (Cth).
